To Learn the TRUTH About What Really Happened to Elvie Kingston
Review this detailed account in the Amended Application for Appointment of Permanent Guardian of the Person & Permanent Guardian of the Estate filed June 10, 2022, Harris County Probate Court
"Court records show 14 pieces of Elvie’s jewelry and six fur coats were awarded to Nubia Devine." (Dolcefino Media/Hartman/Walker)
Disputing the false claim - See DOC A Court Documents Page
Nubia was not "awarded" 14 pieces of Elvie's jewelry.
Relevant excerpts from the attached Court Decree: "It is therefore Ordered, Adjudged and Decreed that Ashley N. Nubia was not "awarded" six fur coats.
Relevant excerpts from the attached Court Decree: "It is therefore Ordered, Adjudged and Decreed that Ashley N. Reiner, Permanent Guardian of the Estate of of Elvie Lou Cruz Kingston, An Incapacitated Person, is authorized to make a distribution of the six (6) fur coats belonging to the Guardianship Estate to Nubia Devine, Guardian of the Person of Elvie Lou Cruz Kingston, An Incapacitated Person, on behalf of and for the use and possession of the Ward ... ."
Quote from Niece Michele Hartman in reference to John and Nubia's involvement in Elvie's care and/or official Probate duties:
“Oh my gosh I’d want to tell her how much we love her and miss her. And if she what was happening, if she knew today, if she was aware of it she would ask why she was in the position she’s in,” said Michele Hartman." (Dolcefino Media/Hartman/Walker)
Michelle's question is one Elvie has surely been asking herself after her family confined her in 5-7 different "care" facilities for a period of approximately 4 months. It seems Michelle (or other family members) placed her in those facilities. Why was Elvie in the position she was found in the first place?
With Elvie's resources, she should have been in much nicer and safer facilities. She also could have been cared for in her own home which would have allowed for 24/7 live-in caregivers (if needed) in surroundings familiar to her.
She never should have been abandoned in such deplorable conditions. She was left in unfamiliar places, frightened, and fed a steady diet of multi-colored slop. When she was finally located, her friends found her wearing dirty clothes (that she had worn for several days), double-diapered and heavily drugged. It seems to most, that is a very odd way to show love for someone.
Not one family member lived close to any of the facilities Elvie was confined in. Elvie has several long-time friends who would have been ready, willing and able to visit with and check on Elvie frequently.
Why did Michelle not ask those friends to check on her and let the family know how she was doing?
Why did someone purchase a new phone for Elvie, change her phone number and provider without telling her friends of her new phone number?
From the condition she was found in, it appears no one was monitoring Elvie regularly nor did they want her to be monitored. Why was that?
SEE DOC C - 2001 Last Will and Testament
John Lewis Kingston executed his Last Will and Testament on July 17, 2001. Relevant provisions to note: Article V, Section 5.01 appointing Elvie Lou Kingston as Independent Executrix of his Will and Estate to serve until she ceases to serve due to her death, resignation, or incapacity. In that event, Michelle Cruz Hartman was appointed to serve as Successor Independent Executrix. SEE DOC D - 2007 First Codicil to Last Will and Testament Executed
John Lewis Kingston executed the First Codicil to his Last Will and Testament on November 16, 2007.
Relevant provisions to note:
Section (B) - Article V, Section 5.01 was deleted. Elvie Lou Kingston remained as the first appointed Independent Executrix of John Lewis Kingston's Will and Estate. Should Elvie become unable to serve in such capacity John Lewis Kingston appointed John Devine to serve as Independent Executor. Michelle Cruz Hartman was moved to third in the line of appointed Successors and Ernest Anthony Cruz was deleted entirely from the line of appointed successors.
in addition:
Article III (Personal Effects & Specific Bequests) of his Last Will and Testament was deleted as originally written. In summary, the following provisions were added.
Section 3.01 was added to provide for the care of the Kingston pets. Other long-time friends were appointed to receive a specific sum of money as caregivers to said pets. If the initial appointees were unable (or unwilling) to care for the Kingston pets, the same sum of money was to be distributed to John Devine for his care of the Kingston pets.
See DOC E - 2nd Amendment to John Lewis Kingston and Elvie Lou Kingston Revocable Living Trust.
Relevant provisions to note:
Similar changes as those made above to Doc D in Article III pertaining to the Kingston's pets were also made in Doc E - (A), Sec. 5.04(2), Article V of the Kingston Revocable Living Trust.
In addition, changes were made to Doc E - (B), Sec. 8.02, Article VIII to reflect the appointment of John Devine as Sole Trustee of the Trust if John and Elvie Kingston are deceased or unable to serve. If John Devine is unable or unwilling to serve, Michelle Hartmen would then serve as Sole Trustee.
